Terms & Conditions

1. DEFINITION
"Online Sales Contract" or "Contract": The purchase and sale agreement related to the Seller's works of art, executed between the Seller and the Buyer as part of a remote sales system using telematic tools, organized by the Seller.
"Buyer": Any individual or entity making a purchase under this contract.
"Consumer": A natural person making a purchase for purposes not related to any commercial or professional activity.
"Seller": AGAS WEB S.r.l., VAT number IT02492920505, headquartered at Via Vecchia Stazione, 28/D, 56031 Bientina (PI), Italy.

2. ACCEPTANCE OF THE CONDITIONS OF SALE
By confirming their purchase order electronically, the Buyer:

  • Unconditionally accepts these Terms & Conditions.

  • Acknowledges that the Seller is not bound by different conditions unless explicitly agreed in writing.

  • Recognizes that the Seller may modify these Terms in the future, with changes applying only to orders placed after the updated Terms are published on the website.

Before proceeding with any purchase, Buyers are advised to verify the compatibility of the voltage system with their electrical system.

3. PRICES

  • Prices displayed on the website are in Euros (€).

  • For EU customers, prices include VAT and any other applicable taxes.

  • For non-EU customers, prices are shown excluding VAT. Customs duties, import taxes, and any local charges are the Buyer’s responsibility and may be requested directly by the courier upon delivery.

  • The Seller reserves the right to modify prices at any time without prior notice.

  • Shipping costs and additional charges, if applicable, are clearly displayed during the purchase process before the Buyer confirms the order.

4. PAYMENT
Accepted payment methods include: Credit Card, PayPal, Klarna.
Payments are made in Euros (€), including all applicable taxes where required.
Ownership of the products remains with the Seller until full payment is received, including shipping and any additional costs.
If payment cannot be processed, the order will be canceled, and the Buyer will be notified by email.

5. BILLING
Buyers must provide their Tax Code and, if applicable, VAT number during registration.
Invoices are issued automatically within the same month as the order and cannot be modified afterward.

6. PRODUCT AVAILABILITY
Product availability may change due to demand. Buyers can contact the Seller for precise information on stock status.

7. ORDERS
Orders are accepted exclusively through the website.
If no confirmation is sent within 3 working days, the order will be considered not accepted.

8. ORDER CANCELLATION
If the Buyer cancels an order after confirmation, the Seller is entitled to compensation equal to 30% of the total order value, without prejudice to the Consumer's legal right of withdrawal under Legislative Decree no. 206/2005.

9. DELIVERY
Upon delivery, the Buyer must:

  • Verify that the number of packages matches the shipping confirmation.

  • Ensure the packaging is intact and undamaged.
    If tampering or damage is detected, the Buyer must indicate "RESERVE TO CONTROL OF GOODS" on the courier's document. Failure to do so releases the Seller from any liability for damages caused by the carrier.

10. DELIVERY COSTS
Shipping costs and delivery times are displayed during checkout.

  • For EU deliveries: No additional duties or taxes are applied (Delivery Duty Paid).

  • For non-EU deliveries: Customs duties and taxes are the Buyer's responsibility and may be invoiced separately by the courier (Delivery Duty Unpaid).

11. RISK AND DAMAGES
The Seller is responsible for the risk of damage or loss until delivery to the Buyer or a designated representative.
If goods arrive damaged, the Buyer must notify the Seller in writing within 72 hours and provide photographic or video evidence of the damage. Failure to comply will void the Seller's obligations.

12. RIGHT OF WITHDRAWAL
Consumers have the right to withdraw from the purchase contract within 14 calendar days of delivery without penalty or providing a reason.
To exercise this right, the Consumer must send a written request to:

Returned products must be intact, in their original packaging, and include all components.
Return shipping costs are borne by the Buyer. Refunds will be processed within 14 days after verifying the product's integrity.

13. CUSTOMS DUTIES AND TAXES
If the Buyer refuses to pay customs duties or taxes, the goods will be returned to the Seller at the Buyer's expense. Refunds will exclude the cost of return shipping and the original shipping cost.

14. PRODUCT WARRANTY
A Legal Guarantee covers defects in conformity for 24 months from the delivery date.
The warranty applies to electrical components and the power supply when used as instructed.
Defects must be reported in writing, with supporting evidence such as photos or videos.
The Seller will verify the defect and may offer repair, replacement, or refund.

15. COPYRIGHT
All site content, including texts, images, and multimedia, is protected by copyright law.
Reproduction or redistribution of content is prohibited without the Seller's prior written consent.

16. CONTRACT TERMINATION
The Seller reserves the right to terminate the contract with valid justification. Refunds will cover only sums already paid, excluding further damages or compensation.
